KALAMAZOO, Mich. — Stryker Corporation reached a $1.425 billion global settlement with thousands of plaintiffs harmed by the company’s artificial hip implants, Rejuvenate Modular and ABG II, in a group of select cases going through mediation in a New Jersey Superior Court and the U.S. District Court of Minnesota.

The Michigan company voluntarily recalled the Rejuvenate Modular-Neck and the ABG II Modular-neck metal-based hip replacement devices in July 2012 as it received complaints of corrosion and “fretting” (rusting and flaking) – the device’s components rubbed against each other while inside the patient’s body.

The settlement will give a base payment of $300,000 to victims that received the Rejuvenate or ABG II hip implants, underwent revision surgery by November 3, 2014, and who meet additional criteria. The award is adjustable depending on circumstances, particularly if the patient had to endure multiple surgeries, infections, or other complications. Depending on the nature of the injuries, plaintiffs could receive as much as $600,000 each.

The deadline for patients to submit their claim for payment under the settlement is March 2, 2015. If the individual did not get revision surgery by November 3rd, they are not eligible for the settlement but can pursue individual litigation claims. It is estimated that the settlement will cover approximately 3,000 people in 39 states

Stryker will continue to face more lawsuits by victims who do not qualify or the settlement. The company will have to make additional settlements or face trial in federal or state court.
