NEW YORK  — Another huge victory for victims of defective transvaginal mesh products was issued in a Delaware court, where a woman won a $100 million verdict.

Deborah Barba was awarded a total of $25 million in compensatory damages and $75 million in punitive damages for the injuries she suffered from Boston Scientific’s transvaginal mesh products. The compensatory damages were for her actual injuries, costs, and medical bills, whereas the punitive damages were meted out as punishment for the company’s negligent behavior and defective product. The jury awarded the verdict after a 2-week trial and 7 hours of deliberation.

History of the Case

Barba was implanted with the company’s Pinnacle and Advantage Fit transvaginal mesh products in 2009. She received the implant to help treat her stress urinary incontinence and pelvic organ prolapse – two conditions the mesh was supposed to help manage and treat. However, shortly thereafter, Barba suffered from various health complications. She twice needed to have surgery to undo the damage, but it was to no avail. The transvaginal mesh is still embedded in her body and she continually suffers because of it.

This is not the first huge victory for women against Boston Scientific. The beleaguered medical device manufacturer has suffered huge losses for its various transvaginal mesh product lines.
