SILVER SPRING, Md. — After weeks of rumors, Takeda Pharmaceutical Company, the maker of Actos, has agree to a $2.4 billion settlement for various lawsuits brought against it regarding the popular diabetes medication. Although this dollar amount sounds very high, it will be spread out among thousands of plaintiffs and their family members. The settlement will be valid as long as 97% of the plaintiffs agree, and a slightly lower settlement amount will go into effect if 95% agree.
These product liability lawsuits, of which there are currently nearly 10,000 pending in the United States, allege that taking Actos resulted in the plaintiffs developing cancer. The lawsuits also allege that Takeda Pharmaceutical was aware of the potential, serious side effects associated with their drug but failed to warn patients of these potentially fatal risks.
The U.S. Food and Drug Administration has acknowledged a strong correlation between Actos use for more than a year and increased risk in developing bladder cancer, and has even ordered the inclusion of the cancer risk on the drug’s label. Nevertheless, court rulings on previous Actos cases have been mixed. Most shockingly, a federal jury awarded a bladder cancer patient and former Actos user with a $9 billion judgment initially, only to have a judge then lower that same judgment to just under $37 million. Additionally, a Wisconsin judge recently found ruled that there was not enough evidence to show that Takeda should be held liable for evidence spoliation in one of the Actos cases. Nevertheless, a Philadelphia jury had previously awarded another cancer patient and former Actos user $36.5 million in damages in a similar lawsuit.
The multi-billion dollar settlement is a good sign for patients and their families who have suffered from the adverse effects of Actos because it shows that Takeda is willing to take these lawsuits seriously and work out a compromise. However, per the terms of this settlement, Takeda still has not admitted liability for any of the issues raised in the complaints and instead claims that settling the lawsuits will help Takeda move on and focus on developing new drugs.
