NEWARK, N.J. — Despite attempts by Benicar manufacturer Daiichi Sankyo and distributor Forest Laboratories to keep Benicar lawsuits separate, 15 Benicar lawsuits from various states will be consolidated in a U.S. Panel on Multidistrict Litigation in New Jersey. There may be 20 or more additional lawsuits that are similar and may be added as well.
Centralization of the lawsuits should make litigation more efficient and less expensive, especially since foreign discovery may be necessary due to Daiichi Sankyo being based in Japan and due to Benicar being developed there. Centralization should also prevent varying outcomes from multiple trials in multiple states. Daiichi Sankyo and Forest Laboratories initially attempted to prevent the centralization of the lawsuits for these same reasons and because, as they alleged, they fear that more suits will be filed following the consolidation. Daiichi Sankyo and Forest Laboratories also alleged that the suits should remain separate since each case was different and had unique circumstances such as the doctors that the individuals saw and the medical treatment that the individuals received. The plaintiffs, many of whom brought the suits in Ohio, pushed for the suits to be consolidated in Ohio or nearby. Although Daiichi Sankyo and Forest Laboratories lost their attempt to keep the lawsuits from being centralized, they did succeed in getting them consolidated in New Jersey, where both companies have their United States headquarters, instead of having them centralized in the midwest, which would have been much more convenient for many of the plaintiffs but significantly less so for the defendants.
Although Benicar has been approved by the United States Food and Drug Administration for use by patients who suffer from high blood pressure, the FDA issued a requirement in 2014 that all Benicar medications be labeled with a warning of the drug’s potentially serious side effects. Most worrying, Benicar has been linked to sprue-like enteropathy, which can be very serious and painful since it often causes intestinal damage, malnutrition, weight loss, renal failure and chronic diarrhea. The Benicar lawsuits that have been filed allege that the plaintiffs suffered from one or more of these side effects and that defendants were aware of these serious health risks but still aggressively promoted their drug despite this knowledge.
