WOBURN, Mass. — A defective pelvic mesh lawsuit brought against Boston Scientific in Massachusetts State Court for nearly $6 million has recently gone to trial, according to CVN.

The plaintiff accuses Boston Scientific of using a polyurethane mesh that is reportedly not suitable for use in humans.

The lawsuit claims that the mesh becomes stiff and brittle when introduced to the human body, leaving consumers suffering from bleeding, incontinence, and pain during intercourse.

In addition to $6 million in compensatory damages, an undisclosed amount of punitive damages are being sought in response to the suffering inflicted by the Uphold-brand implant.

This lawsuit is one of the tens of thousands of lawsuits being brought against Boston Scientific as well as other mesh manufacturers.

A previous case involving Boston Scientific in a North Carolina federal court ended in Boston Scientific’s favor. However, this will be the first Boston Scientific mesh case held in a North Carolina state court.

Recent state court decisions have set a precedent for substantial settlements being awarded to plaintiffs against Boston Scientific. These settlements have totaled as high as $100 million in Texas and Delaware, however, all cases tried in Massachusetts have ended in favor of Boston Scientific.
