PHILADELPHIA — The first confidential settlement has been reached in a wrongful death lawsuit filed against a power morcellator manufacturer.
Scott Burkhart filed a suit against LiNA medical last year after the death of his wife to a very aggressive form of uterine cancer.
His 53-year-old wife, Donna, underwent a standard procedure to remove uterine fibroids in late 2012. She was diagnosed with cancer a week later, despite having no signs of cancer in her body prior to the surgery.
Eleven months later, in February 2013, Donna died of myelosarcoma – a painful and fast moving form of cancer – at the age of 53.
LiNA Medical was the manufacturer of the power morcellator used in her procedure.
The case was scheduled to go to trial later this year, but instead a settlement was reached. While the amount has not been disclosed, it is the first reached in the growing number of power morcellator personal injury and wrongful death cases.
The FDA found that 1 in 350 women undergoing hysterectomy or myomectomy for the treatment of fibroids is found to have an unsuspected uterine sarcoma. The federal agency has yet to ban the device, but in light of this information it issued its strongest warning against the use of the device.
Despite the documented risks and the FDA’s warnings, many hospitals still employ the use of power morcellators in fibroid removal or hysterectomies. As such, women continue to be at risk of contracting cancer after a procedure involving this device. If you have undergone such a procedure, you may be at risk.
