In Johnson & Johnson’s request, it stated that it would like to “conserve judicial resources and avoid the risks of duplicative discovery and inconsistent rulings.” The request also states that, although the plaintiffs have different medical histories and unique specific facts, the complaints are still similar enough to warrant the consolidation.

The cases hinge on whether or not the talc products were the cause of the development of the cancer in the patients. For decades, studies have linked talcum powder with ovarian cancer. However, these studies have mostly been confined to medical circles and have not been widely publicized. Although the United States Food and Drug administration tests to make sure that there is no asbestos in talcum powder and other talc products that are currently for sale, they did not have the same quality controls in place in the 1990s.

A jury in a similar talcum powder lawsuit in Los Angeles recently awarded the plaintiff a $13 million judgment after deliberating for only 2 hours. Despite studies that have demonstrated a link between perineal talc use and the development of ovarian cancer and despite the multi-million dollar judgment against the company, Johnson & Johnson has stated that they still dispute the causation in these cases.
