DALLAS — A federal jury in Texas has ordered Johnson & Johnson and its DePuy Orthopaedics unit to pay more than $1 billion to six plaintiffs over their defective hip implant.
Harris Martin reported the verdict in early December.
According to the report, juriors concluded that the metal-on-metal Pinnacle hip implant was defectively designed and that the companies failed to warn consumers about the risks. Due to the manufacturer’s negligence, the plaintiffs successfully argued that Johnson & Johnson purposely hid flaws in their implants, which required them to be surgically removed.
J&J said in a statement it would immediately appeal the verdict.
Mark Lanier, the plaintiff’s lawyer, told Reuters that the total verdict of $1.041 billion included $32 million in compensatory damages. The rest were punitive damages,
Bloomberg reports Johnson & Johnson still faces more than 9,000 lawsuits, accusing the device manufacturer of mishandling the metal on metal hips.
Johnson & Johnson reportedly stopped selling the hip replacements in 2013 after the FDA toughened artificial hip regulations.
