LOS ANGELES — A California state judge has reportedly passed a motion to coordinate 55 cases filed against Bayer by women who claim Essure, the manufacturer’s permanent birth control device, caused them harm.

Modern Healthcare first reported the motion Oct. 3.

The mechanism of civil case coordination allows two or more cases that “share common questions of fact or law and that are pending in different counties to be joined in one court,” according to California’s judicial branch. With coordinated cases assigned to a single judge, one ruling applies to them all, Modern Healthcare reported.

“I’m hoping that it’ll be a quicker, more efficient, cohesive resolution to all women’s cases in California,” Elizabeth Graham, a lawyer with the firm Grant & Eisenhofer, told Modern Healthcare.

Graham is one of the lawyers representing the plaintiffs.

In early August, Judge Winifred Smith, of the Superior Court in Alameda County, reportedly allowed 11 consolidated lawsuits representing 14 women who said they were injured by Essure to proceed after Bayer sought on three separate grounds to have them thrown out. Smith later recommended that the coordinated proceedings be conducted in her court, a decision that now reportedly rests with the chair of the Judicial Council.

Essure, a non-surgical birth control device implanted in the body, is a nickel-titanium coil that contains polyethylene terephthalate fibers — a plastic not intended for permanent implantation in the human body.

The controversial device is inserted in a woman’s left and right Fallopian tubes where it causes an inflammatory response that permanently blocks the tubes, and renders the patient sterile.

The device was approved by the U.S. Food and Drug Administration in 2002.

The Food and Drug Administration has received more than 5,000 complaints of adverse effects, including organ perforation, pelvic pain, unintended pregnancies and abnormal bleeding.
