LAS VEGAS — Takeda Pharmaceuticals has become the subject of a lawsuit claiming that their drug, Actos, causes bladder cancer in consumers, according to the Las Vegas Review Journal.

The lawsuit is being filed by the family of Moshe Bitton, an Actos user who developed bladder cancer and died on Oct. 23, 2013 – it is being handled in the U.S. District Court in Las Vegas.

There are currently thousands of plaintiffs who have filed lawsuits against Takeda with one of the most significant cases resulting in Takeda being ordered to pay $6 billion in punitive damages – although that settlement was later decreased.

Takeda Pharmaceuticals allegedly knowingly failed to inform consumers and medical professionals of the heightened risk of bladder cancer that consumers of Actos are subjected to. This neglect persisted for over a decade as Actos has been available on the U.S. market since 1999.

While the FDA issued a safety announcement in 2011 stating that extended Actos use may lead to a heightened risk of bladder cancer, the warning has come too late for many users.

With Actos being one of the worlds most popular drugs, the risk of millions of consumers being exposed to dangerous health risks poses a need for stiffer action on behalf of the FDA.

At its peak, Actos “had global sales of $4.8 billion and accounted for approximately 27% of Takeda’s revenue.”

In an email written by Kenneth Greisman, senior vice president and general counsel for Takeda Pharmaceuticals, he responded to allegations of Actos danger with “Of the eight cases that have gone to trial, Takeda has prevailed in five cases, and we are challenging the outcomes in the other three cases.”
