KANSAS CITY, Kan. — In an effort that indicates just how many women have been harmed by the power morcellator, plaintiffs’ attorneys across the country are seeking to consolidate cases.
A power morcellator is a series of small circular blades attached to a vacuum like tube. This once popular surgical device is used to remove fibroids from the uterus and to perform minimally invasive hysterectomies. Doctors make a small incision in the abdomen and insert the power morcellator. The whirling blades chop up the tissue and the vacuum tube draws it out.
It has been found, however, that that power morcellator creates a serious health hazard. Often hidden within uterine fibroids (harmless growths in the uterus) is a dangerous form of uterine cancer. When the fibroid is sliced by the morcellator and drawn out of the body, the hidden cancerous cells have the opportunity to spread aggressively to other parts of the body.
Thousands of women are now finding this to be the case — many with no signs of cancer until months after a morcellation procedure. Johnson & Johnson is the largest maker of the power morcellator. The FDA has issued its strongest “black box” warning against the device, but has not recalled it. The federal agency found in a recent study that 1 in 350 women who undergo a power morcellation procedure to remove uterine fibroids or their uterus had a hidden or dormant sarcoma (cancer).
Multidistrict litigation is a means of tackling multiple cases in federal court in a more efficient manner, as it involves shared cases, shared evidence, and shared stories.
In the case of defective or dangerous medical devices, it means many individuals were harmed in a similar fashion by the same model or brand of medical device. The most recent MDL request looks to consolidate at least 22 cases existing in federal court and transfer them to the U.S. District Judge Kathryn Vratil in Kansas.
