The U.S. District Court for the Northern District of Illinois is where the Zimmer NexGen Knee implant MDL is taking place. By pushing for a motion for summary judgment, Zimmer is looking to cut the trial at its knees by claiming the plaintiff does not have enough material factual evidence or issues at hand for the case to even go to trial i.e. the judge has nothing to decide. On something as critical as the defective design claim, a ruling in favor of Zimmer on the motion would have struck at the very heart of many of these cases. The judge, however, denied the motion for summary judgment and so the case moves forward.
