Are Nexium Lawsuits Being Awarded Settlements?

Since 2011, AstraZeneca has faced multiple lawsuits alleging their drug causes complications ranging from bone and kidney damage to serving as a catalyst for the onset of dementia.

A 2011, lawsuit alleging that Nexium caused bone damage was the first of these lawsuits to be filed. These lawsuits were consolidated under multidistrict litigation (MDL) in the U.S. District Court for the Central District of California in 2012.

However, this MDL was closed after Judge Dale S. Fischer ruled in favor of AstraZeneca citing failure of the plaintiffs ability to provide sufficient evidence that Nexium use and bone damage constituted a causation relationship.

In 2013, a lawsuit against AstraZeneca alleging deceptive marketing on behalf of the Nexium manufacturer was settled for $20 million. This suit alleged that AstraZeneca had advertised that Nexium was superior to Prilosec, a cheaper generic version of the drug.

It was determined that the more expensive drug – Nexium – was in no way superior to the generic version.

The settlement was paid to those who consumed Nexium in Massachusetts between 2001 and 2013.

A later 2015 case involving Nexium resulted in AstraZeneca paying $7.9 million to settle claims that they had paid Teva Pharmaceuticals illegal kickbacks to delay the introduction of a generic version of Nexium that would serve as a direct competitor.

Other lawsuits based on related allegations have been settled they have all been on the grounds of antitrust, illegal payments, or deceptive marketing grounds.

Settlements have not been awarded to plaintiffs who have filed lawsuits alleging Nexium carried undisclosed, dangerous side effects that indicated AstraZenecas failure to develop a safe product for their consumers.

With cases citing kidney complications being filed in increasing numbers, the likelihood of AstraZeneca offering settlements to the plaintiffs in these cases are increasing.
