BISMARCK, N.D. — North Dakota will receive $3 million as part of a financial settlement that totals $1.2 billion in payments from Johnson & Johnson and $400 million from Janssen Pharmaceuticals, according to the Bismarck Tribune.
The settlements come from the resolution of both civil and criminal cases brought against Johnson & Johnson and its subsidiary alleging that both companies engaged in unlawful marketing practices.
The $3 million North Dakota will receive includes approximately $923,000 paid directly to the state Medicaid program with the federal government receiving the remaining $2.07 million.
“This is a fairly common settlement that has happened over the years,” Brendan Joyce, administrator of Pharmacy Services for the Department of Human Services, said to the Bismarck Tribune.
The lawsuit resulted from the complaint of a whistle blower in which allegations that Johnson & Johnson was marketing Risperdal for unapproved uses were first made.
