The case previously chosen was abandoned as the plaintiff announced intent to have the suit dismissed.
This case, coming after Zimmer won the first bellwhether, involves a woman who received an implant in 2009 and later had to undergo revision surgery after a recall ordered by the FDA.
The lawyer representing the case against Zimmer Inc. said the victim who filed the lawsuit “has more of a constrained knee now, coming out of revisions surgery.”
According to the lawsuit, Zimmer allegedly knew about the risks associated with the joint and failed to fulfill its duty to warn doctors of them.
Besides the second bellwhether trial, four additional bellwhethers will follow in late 2016 and 2017.
