SILVER SPRING, Md. — The Risperdal trials are underway, and so far things are looking good for once for the plaintiffs who are alleging that they suffered serious side effects while using Johnson & Johnson’s anti-psychotic drug Risperdal. Most notable in the cases’ progression so far is testimony by the former head of the United States Food and Drug Administration (FDA), David Kessler, that the FDA was aware of the potential risk that Risperdal may result in breast development in its male users. In his testimony, Kessler cited a 2001 study that demonstrated these serious negative side effects, which occurred in 3.8% of boys who took the drug. Kessler went on to say that even though this information was known in 2001, a label warning of the risks was not included on the drug until 5 years later and that the manufacturers encouraged off-label prescription of the drug by doctors.

In this particular case, the 20-year-old plaintiff is alleging that Risperdal was responsible for him gaining 100 pounds and developing abnormal, male breasts. There are over 1,000 other similar cases pending in Philadelphia right now that allege similar injuries and list Johnson & Johnson and/or Janssen Pharmaceuticals as defendants. Many of the other lawsuits also allege that the plaintiffs suffered from male breast growth, known medically as gynecomastia, but some also allege other negative side effects such as diabetes.

Although Johnson & Johnson settled a similar case in 2012 and also pled guilty for its role in encouraging the off-label use of Risperdal in elderly patients with dementia, Johnson & Johnson claims that they had made the risks clear to doctors and were not trying to hide the possible side effects of their drug. Janssen Pharmaceuticals also claims that their drug has improved the lives of many people – both children and adults – who suffer from mental illness. Despite the defendants’ claims, in 2013, Johnson & Johnson agreed to pay $2.2 billion for lawsuits involving three drugs, including Risperdal, which alleged that they had illegally targeted their drugs for off-label use.
