TRENTON, N.J. — Dozens of lawsuits filed against Benicar manufacturer, Daiichi Sankyo Co. Ltd., in New Jersey have now been consolidated in the Atlantic County court following an order this summer. The New Jersey Supreme Court’s order will apply to the Benicar lawsuits that are currently pending in New Jersey as well as future lawsuits that regard the same issue. The order also extends to other lawsuits that were brought against manufacturers of other blood pressure drugs that are similar to Benicar and that contain olmesartan medoxomil.

History and Status of Benicar Lawsuits

Benicar was first approved for use in treating hypertension (or high blood pressure) by the United States Food and Drug Administration back in 2002. However, the FDA issued an update in 2013 warning of the serious health complications that have been linked to it, specifically sprue-like enteropathy. Sprue-like enteropathy can cause gastrointestinal complications resulting in malnutrition, weight loss and chronic diarrhea. These gastrointestinal complications can continue permanently – even after the patient has stopped taking the medication. Benicar has also been linked to kidney failure.

The FDA followed up this warning in 2014 with a requirement that Benicar containers include a warning label disclosing these risks. As a result of these serious complications being linked to Benicar, several patients have filed lawsuits against the drug’s manufacturer, Daiichi Sankyo, and against the drug’s promoter, Forest Laboratories.

These lawsuits allege that the plaintiffs suffered from one or more of these side effects and that these side effects were the result of taking Benicar. The lawsuits also allege that the defendants knew or should have known about these serious health risks but that they still aggressively promoted their drug despite this knowledge.
