MARTINSBURG, W.Va. — A jury recently ordered Takeda Pharmaceutical Company, Ltd. to pay $155,000 after Takeda destroyed files regarding drug development and marketing. The jury concluded that the files were intentionally destroyed and that they would have helped a plaintiff in his claim that the Takeda-manufactured drug, Actos, was the cause of his cancer. The judge in the case stated that Takeda employees had deleted relevant files after they had been told to keep documents relating to Actos. The lawsuit further asserts that Takeda and other companies involved in the manufacture and distribution of the drug downplayed Actos’, and that they even misled the public and medical professionals about the drug’s major health risks.

What is Actos?

Actos is a drug that has been used by people with Type 2 diabetes in order to control blood sugar levels. Unfortunately, using Actos has also been shown to increase your risk of getting bladder cancer. Other serious side effects besides bladder cancer include congestive heart or liver failure, chronic kidney disease and even vision loss.

Even before the jury determined that Takeda had deliberately destroyed files that would have helped former Actos users in their lawsuits, juries had already begun ruling against Takeda in other lawsuits. Most notably, Takeda and affiliated Eli Lilly and Company were recently ordered to pay nearly $37 million after they were found liable in a similar case. Of the eight Actos lawsuits that have been tried, five of them have been found for the plaintiff and against the manufacturer. There are thousands of other cases against Takeda and other companies linked to Actos that are currently pending. The ruling against Takeda for destroying relevant files may be used against the company and other companies linked to it in subsequent litigation.

In its defense, Takeda stated that they had not intentionally deleted the files and pointed out that they had produced many other documents related to Actos research and development. Although Takeda stated that it is considering appealing the judgment, this $155,000 award as well as recent lawsuits that have found Actos drug manufacturers liable is more relatively good news for people who have suffered from Actos’ side effects.
