BOSTON — A medical insurer has brought a lawsuit against testosterone gel manufacturers and their subsidiaries for their tactic of covering up the negative side effects of using testosterone gels. The medical insurer, Medical Mutual, also claim that the makers’ marketing strategy was deceptive.

Data from the Studies

According to studies that were published in the Journal of the American Medical Association and in the New England Journal of Medicine, there is an increased risk of heart attacks or other cardiovascular problems for men who take testosterone, particularly for testosterone users who are older or who already have a history of cardiovascular issues. If you are over 65, taking testosterone supplements can double your risk of having a heart attack.

Specifics of the Complaint

In the complaint, Medical Mutual has named Abbvie, Inc., Abbott Laboratories, Solvay America, Inc., Auxilium, Inc., Eli Lilly and Company, Acrux Limited, Actavis, Inc., Watson Pharmaceuticals, Inc. Anda, Inc. and Endo Pharmaceuticals, Inc., among other companies that are affiliated with manufacturing and marketing testosterone replacement therapy drugs. This lawsuit will affect the makers and distributors of AndroGel, Androderm, Axiron, Fortesta Gel, Testim and Testopel.

The complaint specifically alleges that the defendants:

  1. falsely and deceptively oversold the efficacy of the TRT drugs,
  2. failed to adequately warn of, and affirmatively misled the medical community regarding the severe side effects of the TRT drugs, and
  3. unlawfully promoted the TRT drugs for usage in populations for which it had not received FDA approval and for which the efficacy and side effects had not been established through adequate clinical evidence.

Testosterone gels were initially developed to treat low levels of testosterone that occur in a very small percentage of men, and that remains the only use for which they have been FDA-approved. The lawsuit alleges that each of the named defendants used fraud to increase unlawful, off-label usage of the drug, for which the drug had not been tested. The alleged fraud includes the defendants overstating the safety and efficacy of the drugs in these unlawful and off-label usages. The complaint also alleges that the defendants overrepresented the number of men who would benefit from the use of testosterone gels.
