Testosterone lawsuit defendants and plaintiffs are currently in the process of selecting 12 out of the pending testosterone lawsuits to be tried in preliminary bellwether trials. Agreement is expected to be painstaking especially since there are currently 2744 of these testosterone lawsuits pending across the nation. This is up from just under 2000 just a few months ago in August of this year. Although only 12 of the thousands of testosterone cases will eventually be heard in the bellwether trials, there are currently 32 cases being considered since each side was able to request 16 cases.
Bellwether Trial Details
Six of the 12 cases will be for lawsuits that allege that the testosterone user experienced blood clots as a result of using the testosterone therapy while the other half of the cases will be reserved for lawsuits that allege that the plaintiff suffered a stroke or a heart attack as the result of using the testosterone supplement. Despite there being a total of seven testosterone supplement manufacturers who have been named in these lawsuits, the first set of bellwether trials will be for lawsuits filed against AbbVie for their topical product called AndroGel. Other manufacturers who have been named in lawsuits include Abbott Laboratories, Actavis, Inc., Auxilium Pharmaceuticals, Eli Lilly & Company, Endo Pharmaceuticals, Pfizer, Pharmacia & Upjohn, and Watson Laboratories for a variety of gel, pill, and patch testosterone products including Androderm, Delatestryl, Fortesta, Axiron, Depo-Testosterone, and Testim.
Testosterone Lawsuit Allegations
The thousands of lawsuits may name different manufacturers, but the allegations remain largely the same. The lawsuits allege that the plaintiffs were injured as a result of using testosterone products. Most of the injuries alleged are cardiovascular injuries such as heart attacks, strokes, deep vein thrombosis or blood clots. The lawsuits also allege that they were given the products for uses that were not approved by the FDA and that the plaintiffs were not adequately warned of the serious risks that were linked to the drugs. Although the litigation continues to move forward, men who have been injured by using testosterone products are still able to join the mounting cases.
