MIAMI — A Florida woman suffering injuries from transvaginal mesh has filed RICO charges in the U.S. District Court for the Southern District of Florida.
RICO, also known as Racketeer Influenced Corrupt Organizations Act, is the federal violation most commonly associated with mobsters and drug cartels. Now it can be associated with the manufacturers of the defective and dangerous medical device transvaginal mesh.
Ethicon Faces RICO Lawsuit
Ethicon is one of seven major manufacturers facing thousands of transvaginal mesh lawsuits in state and federal court, but it is the first to face RICO charges. Ethicon, a unit of pharmaceutical giant Johnson & Johnson, was accused of violating RICO laws in the Florida case because of its alleged cover up of the risks associated with its transvaginal mesh devices Gynecare TVT System and Prolift (Case No. No. 15-20442).
The complaint alleges they knew of the dangers as far back as 1999 even though the official FDA only issued its first public health warning in 2008.
Problems with Transvaginal Mesh
Transvaginal mesh is a surgical netting that was developed to help treat pelvic organ prolapse and stress urinary incontinence. It supports the weakened muscles in the pelvic region in order to prevent the neighboring organs from falling through into the cavity (also known as pelvic organ prolapse).
Transvaginal mesh, however, has been found to not only cause pelvic organ prolapse, but other health complications, because the mesh has the tendency to erode and break off into pieces. The eroding mesh can cause serious problems including pain, swelling infection, organ perforation, bleeding, and sexual dysfunction. The only solution is for the patient to have additional surgeries to remove the mesh and repair the damage.
Thousands of women have pursued lawsuits against the various makers of transvaginal mesh and both federal and state courts have been granting substantial recoveries to the victims – reaching into the millions.
