WASHINGTON D.C. — Despite the defendants’ attempts to prevent Xarelto lawsuit plaintiffs from consolidating their suits in order to make filing easier, the suits will officially be heard together in Louisiana. The United States Judicial Panel on Multidistrict Litigation (JPML) made the decision recently in spite of the defendants’ arguments that the medical history and amount of the drug taken were too different to warrant a consolidated suit. In addition to not getting separate lawsuits like they would have preferred, the defendants, Bayer AG, which is based out of Germany, and U.S. corporation Johnson & Johnson, also did not get the jurisdiction that they wanted. Despite the defendants’ counter attempts to have the suits centralized in federal court in New Jersey near their U.S. corporate offices, the JPML decided to centralize them in Louisiana. The centralization will save both sides time and money, but it will especially benefit plaintiffs, whose numbers continue to grow. The pretrial information will be heard in Louisiana, and then the trials will be held in the states in which the suits were brought.
Cases Allege Risks of Xarelto Downplayed
Many of the cases allege that Bayer and Johnson & Johnson downplayed the risks of severe bleeding while touting Xarelto’s positive uses. Several suits call into question whether the companies knew about the extent of the negative side effects from their clinical trials of the drug. Xarelto is used to reduce the risk of blood clots, but it has been linked to internal bleeding, which has resulted in death in as many as 65 reported cases. Xarelto is similar to another oral anticoagulant called Pradaxa, both of which were created to replace Coumadin. Pradaxa and Xarelto were supposed to be a step up from Coumadin, a blood thinner that has been around for decades, because they do not require blood tests or dietary restrictions for their use. Xarelto is particularly dangerous because there is no antidote to stop the bleeding once it has begun, so patients have to wait until the drug leaves their system for the bleeding to stop. The relatively good news for Xarelto users is that a Pradaxa lawsuit alleging similar injuries recently settled for 650 million dollars.
