NEW ORLEANS — A Georgia man has filed a lawsuit against Bayer Healthcare, Johnson & Johnson, and its Janssen subsidiary, alleging that his consumption of Xarelto caused catastrophic intracranial bleeding.
According to court documents, doctors instructed Oren Fells to begin taking the anticoagulant in 2013, as treatment for a heart condition. Several months later, Fells was rushed to the hospital with serious brain bleeding, which caused serious and permanent injuries. His lawsuit demands unspecified damages.
To date, there have been about 2,500 lawsuits filed in federal courts by victims who allege that Xarelto led to uncontrollable bleeding and other serious injuries. These cases are consolidated in the Eastern District of Louisiana courtroom of U.S. District Judge Eldon Fallon.
Fallon has scheduled four bellwether trials for the spring of 2016: two in Louisiana, one in Mississippi and one in Texas.
In May 2014, Boehringer Ingelheim agreed to settle similar claims regarding Pradaxa, the precursor to Xarelto, for $650 million.
Xarelto Side Effects
Practitioners have long used anticoagulants in heart patients and in other situations.
The U.S. Food and Drug Administration initially approved Xarelto for use in patients who were recovering from hip or knee replacement surgery. The agency later expanded the list of approved uses after a cursory review process that has since been discontinued.
Xarelto is much more powerful than Pradaxa, because it both inhibits the production of a clotting protein (Factor Xa) and reduces the number and size of any clots that are already in the patient’s body.
- Loss of consciousness,
- Abdominal bleeding,
- Stroke, and
- Life-threatening allergic reactions.
The lawsuits allege that Janssen knew about the risks inherent in this dangerous drug and refused to disclose them to doctors and patients; as a result of the manufacturer’s negligence, the victims may be entitled to both compensatory and punitive damages.
