The lawsuit, which took nearly a decade to complete, finally settled for $20 million in 2013. Settlements were paid to consumers who purchased Nexium in Massachusetts between the dates of March 1, 2001 and February 6, 2013.
Violation of False Claims Act
In February 2015, The United States Justice Department settled a dispute with Nexium manufacturer, AstraZeneca for engaging in a kickback scheme with pharmacy benefit manager company Medco Health Solutions. The Justice Department alleged that the drug manufacturer was providing price reductions to the benefit manager in exchange for marketing advantages that were meant to boost profits. The settlement reached required AstraZeneca to pay out $7.9 million to the government.

Four months after the Justice Department settlement was reached, A U.S. district judge approved another settlement against Teva Pharmaceuticals, another big pharma giant, for intentionally keeping generic versions of Nexium off the market. The lawsuit alleged that three companies, AstraZeneca, Ranbaxy Inc., and Teva participated in an overcharging plot to delay the introduction of generic versions of the prescription drug Nexium. The class action lawsuit settled for $24 million.
