Nexium Lawsuit: File a Nexium (Purple Pill) Lawsuit

Important lawsuit information about Nexium:

Nexium Compulsive Behavior Lawsuits

A proton pump inhibitor, Nexium has been used by patients to treat symptoms of acid reflux, heartburn and GERD since it was introduced to the market by pharmaceutical giant AstraZeneca in 2001.

In its short history, Nexium — which is widely recognized as the purple pill — has been a frequent subject of controversy. Several lawsuits have already been filed and settled against the drug manufacturer for complications previously not disclosed, as well as questionable business tactics employed in their promotional strategy.

Commonwealth Care Alliance, et al. VS AstraZeneca Pharmaceuticals L.P., et al

A consumer fraud class action lawsuit was filed in Suffolk County Superior Court alleging that AstraZeneca deceptively marketed Nexium. The plaintiffs in the lawsuit maintained that AstraZeneca advertised Nexium as being a superior medication than Prilosec, another proton pump inhibitor produced by the company. Because Prilosec had a generic version (Omeprazole) available for a much cheaper price, the lawsuit alleged the company deceived the public into believing the more expensive Nexium was a better option.

The lawsuit, which took nearly a decade to complete, finally settled for $20 million in 2013. Settlements were paid to consumers who purchased Nexium in Massachusetts between the dates of March 1, 2001 and February 6, 2013.

Violation of False Claims Act

In February 2015, The United States Justice Department settled a dispute with Nexium manufacturer, AstraZeneca for engaging in a kickback scheme with pharmacy benefit manager company Medco Health Solutions. The Justice Department alleged that the drug manufacturer was providing price reductions to the benefit manager in exchange for marketing advantages that were meant to boost profits. The settlement reached required AstraZeneca to pay out $7.9 million to the government.

Nexium Antitrust Class Action Lawsuit

Four months after the Justice Department settlement was reached, A U.S. district judge approved another settlement against Teva Pharmaceuticals, another big pharma giant, for intentionally keeping generic versions of Nexium off the market. This pay-for-delay scheme benefited the Nexium manufacturer AstraZeneca, as the expensive purple pill-brand drug sales continued to climb. The lawsuit alleged that three companies, AstraZeneca, Ranbaxy Inc., and Teva participated in an overcharging plot to delay the introduction of generic versions of the prescription drug Nexium. The class action lawsuit settled for $24 million.

Current Nexium Lawsuits

Several Nexium users have come forward claiming the drug may be responsible for serious kidney complications such as acute kidney injury, chronic kidney disease and interstitial nephritis. Lawsuits are expected to be filed as more patients are diagnosed with kidney complications while taking this medication. If you have been diagnosed with kidney injuries or interstitial nephritis after using Nexium or other proton pump inhibitors, you may be eligible to file a lawsuit and receive compensation.

What are the Criteria for Filing a Proton Pump Inhibitor Lawsuit?

Proton pump inhibitors (PPIs) were introduced in the late 1980s for the treatment of acid-related disorder of the upper gastrointestinal tract, including peptic ulcers and gastrointestinal reflux disorders, and are available both as prescription and over-the-counter drugs.

Drug Lawsuit Source is currently investigating PPI-induced Acute Interstitial Nephritis (AIN), which is a condition where the spaces between the tubules of the kidney cells become inflamed. The injury appears to be more profound in individuals older than 60.

While individuals who suffer from AIN can recover, most will suffer from some level of permanent kidney function loss. In rare cases individuals suffering from PPI-induced AIN will require kidney transplant.

Our top-rated lawyers are handling individual litigation nationwide and currently accepting new Proton Pump Inhibitor cases in all 50 states.

Below is the criteria required for filing a proton pump inhibitor lawsuit:

  • Patient took one of the following PPIs by prescription or over-the-counter for at least one year:
    • Nexium
    • Prilosec
    • Dexilant
    • Prevacid
    • Protonix
    • Aciphex
    • Zegerid
  • Patient diagnosed with new onset of one of the following while taking the PPI:
    • Acute kidney/renal failure
    • Chronic kidney/renal disease
    • Acute interstitial nephritis

Both patients and their families are seeking compensation for damages. You may be entitled to a settlement if you were harmed by PPI’s.

Why File a Nexium Lawsuit?

Nexium lawsuits are filed against AstraZeneca, the company that manufactures the drug. Lawsuit allegations are expected to state that AstraZeneca:

  • Failed to warn the public of the risks associated with taking Nexium
  • Failed to properly test Nexium for dangerous kidney complications
  • Withheld research data from the public about Nexium dangers
  • Sold Nexium even though they knew it could be dangerous
  • Manufactured and sold an unsafe heartburn medication

Settlements in Nexium lawsuits will provide compensation for pain and suffering, medical bills, and lost wages. In the event that a family member has passed away from serious kidney complications, lawsuits will seek compensation for the wrongful death of the loved one.
